App: Hearing Pal

1. Agreement

By downloading or using Hearing Pal ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. License

We grant you a personal, non-exclusive, non-transferable license to use the App on devices you own or control, subject to the Apple App Store and Google Play rules and these Terms.

3. Not medical advice

The App provides a consumer hearing screening, not a medical diagnosis. Results may be inaccurate due to device volume, headphones, background noise, user input, or other factors. The App is not a substitute for professional audiological or medical care. Seek professional help for hearing concerns.

4. Eligibility

You must be legally able to enter this agreement in your country. The App is intended for adult consumers.

5. Subscriptions

  • Premium access is offered as an annual auto-renewing subscription. The price is shown in the App and in the store listing, and may be presented as a weekly equivalent of the annual price.
  • Payment is charged to your Apple ID or Google account.
  • The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, or as otherwise required by Apple or Google.
  • Manage or cancel the subscription in your device's or store account subscription settings.
  • No free trial is offered unless explicitly stated in the store listing for a specific offer.
  • Refunds are handled by Apple or Google under their respective policies.

6. Premium features

While subscribed or otherwise entitled, Premium may include unlocking the full report, unlimited retests, and related features described in the App. Features may change over time as reflected in the App or store listing where required.

7. Acceptable use

You agree not to misuse the App, reverse engineer it except where allowed by law, interfere with its operation, or use it for clinical diagnosis or to provide medical services to others as if it were a certified medical device.

8. On-device data

Screening data stays on your device unless you export or share it yourself. We are not responsible for loss of local data after uninstall, device failure, or clearing storage. Subscriptions can be restored via Restore Purchases. Local screening history may not return after reinstall.

9. Third-party services

The App may rely on Apple, Google, RevenueCat, and (if enabled) Meta. Their terms and privacy policies apply to their services.

10. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES ARISING FROM USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP SUBSCRIPTION IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ZERO IF YOU ONLY USED THE FREE FEATURES.

12. Health and safety

Use headphones at a comfortable listening level. Stop if you feel discomfort. The App cannot guarantee a quiet environment or correct device calibration.

13. Changes and termination

We may update these Terms or the App. We may suspend or stop offering the App. Continued use after changes constitutes acceptance where allowed by law.

14. Governing law

These Terms are governed by the laws of Türkiye, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
